Social Security disability claims can help achieve NFL disability benefits
As an Atlanta Social Security disability attorney I have worked with a number of retired NFL players, including several members of the Hall of Fame, to help improve the NFL's disability system. Retired players currently receive disability benefits from the Bert Bell/Pete Rozelle NFL Retirement Plan. This plan has much to offer, but the burden of proof for disability claims is impractical and often requires vigorous legal representation. Using approved Social Security claims as leverage, I help retired NFL players obtain line of duty (LOD) and total and permanent (T&P) disability benefits.
A new approach to NFL disability claims
Working with the Retired Football Players Association (RFPA), I have helped write a proposal that can be implemented for the benefit of all NFL players, past and present. This pragmatic document addresses many of the current NFL disability policies and problems, explaining why they have proven to be both ineffective and counterproductive. It also identifies key areas of common practice that have consistently ignored or violated Federal HIPAA (Health Insurance Portability and Accountability Act) and ERISA (Employee Retirement Income Security Act) laws over the years. My critique of the NFL disability system is featured in The Unbroken Line by Spencer Kopf and Billy Joe Dupree, with publication anticipated in 2010.
